Copyright and Your InsanelyArt Submission

We respect the intellectual property rights of others, and require that the people who use the InsanelyArt Site do the same.

If you believe that a submission on InsanelyArt infringes upon your copyright you may either report the submission using our internal reporting system or send us a copyright notice via email. A member of staff will review your notice and resolve the situation.

a. If you believe that your work has been copied in a way that constitutes copyright infringement, please forward the following information to the Copyright Agent named below:

  • Your name, address, telephone number, and e-mail address;
  • A description of the copyrighted work that you claim has been infringed;
  • A description of where the alleged infringing material is located;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; and
  • A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

b. Please do not send us notice pursuant to this section by regular mail, as we may not receive it in a timely fashion. In all cases, if you do not hear a response from us within 2 days of submitting a complaint, please email us at contact ( at ) insanelyart.com to confirm that we received your original complaint. As you may know, spam blockers sometimes reject important emails from unknown parties.

c. We will not comply with requests to remove an image where the complainant cannot prove that they own the copyright in the image in question. Therefore, please provide proof of copyright registration in the image or text concerned, OR, absent such registration, other evidence to support your claim that you own the copyright in the image or text.

d. Please note that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that any material on our site infringes your copyright.

How Can I Avoid Infringing on Someone's Copyright?

The best way to avoid infringing on the rights of another creative person is to use your skill, talent and imagination to create your own completely original work. When we use the word 'original' we don't mean that you must come up with an idea which hasn't been used before, when used in copyright matters "original" means that you created your work without referencing or deliberately copying anyone else's work during the process.

What Happens When You Submit Infringing Works to InsanelyArt?

When we become aware that a InsanelyArt submission infringes upon the copyrights of another artist, creative person or company, we will immediately delete it. This is a legal requirement which we fulfill immediately;

If you take my work down am i protected from a lawsuit?

No. Even if InsanelyArt takes an infringing work down, if you put it up on InsanelyArt you may still be responsible for very significant damages if the copyright owner decides to sue you.
